I agree this is a bad choice.  One is direct violence, the other is an a more indirect type of pain.

I don't think rape can happen in a marriage that is anywhere near healthy.  A husband and wife try to accomodate each other's needs.  If they're not in the mood at the same time, they'll compromise.  A man or woman may sometimes "perform" when they'd really rather not, but by the same token, a partner who really wants it will sometimes forego sex if the other partner is clearly not in the mood.

Bringing charges of rape within a marriage should only be done in the most extreme circumstances, and if that were ever to happen, it really couldn't be said that a marriage actually exists.

Option 1 is more immoral and probably more painful emotionally(physical should be obvious) so that's what I voted, though those who've never seen how adultery can hurt someone probably don't understand the level of emotional pain it can cause. When my step-dad cheated on my mom she was really hurt(almost to the level of when my dad died), though I think it was the fact that he outright lied about it when confronted(she had the proof, but he didn't know that) that hurt the most - people make mistakes, but being dishonest about it just makes the violation of trust much worse.

Dude, why are you so focused on making adultery legal everywhere?  It's not just about sex; it's a breach of contract.

It's a private matter that the state shouldn't be involved with. This is perhaps another reason why it might make sense for the government to get out of marriage alltogether and just issue civil unions.
