The question of the ratification of the amendment was never settled, but my assumption would be that no, it was not.

Given the questions regarding the proper enactment of the amendment that reduced the major party threshold from five members to three, it would be advisable for someone to file suit against the RG to clarify.

The constitution requires "approval by public referendum wherein each citizen shall vote by public post". Each citizen. If a region requires an amendment to be passed by popular referendum, and any citizen did not vote in the referendum, then the amendment can not be adopted by that region. Note that this also applies to the so-called "18th Amendment", which was never in fact adopted.
In the unlikely case that the SC is willing to let this piece of utterly moronic amendment-drafting slip and accept the 17th amendment as intended instead of as written (couldn't have happened in the golden days. Such a court decision, that is, not the bad drafting itself), it is highly dubious whether a tied vote can be redefined as an 'approval'. That seems to be doing some violence to the English language.

Gass introduced an amendment that I think would address some of these concerns:

Political Party Organization Amendment

Article V, Section 1, Clause 7 of the Constitution is hereby repealed and Article V of the Constitution is hereby amended to add the following section:
"Section 3: Political Parties
"1. Any political party of ten or more members shall be classified as an organized political party.
"2. A political party with fewer than ten members shall also be classified as an organized political party if it meets or exceeds a conditional threshold of membership and submits to the Registrar General documentation demonstrating its organization. The conditional threshold for major party status shall be set at three members unless otherwise defined by statute. Guidelines for the demonstration of party organization shall be set by the Registrar General.
"3. Should a political party with ten or more members fall below ten members but not below the conditional threshold for organized party status, it shall not be required to provide documentation in order to maintain its organized party status unless such documentation is specifically requested by the Registrar General."

This would allow smaller parties to be recognized, but limit recognition to groups that are actual parties.
