I for one will sue if a legitimate candidate is excluded from the ballot because our SoFE decided he wantes to play drama queen.

The President should fire you and run the election himself, putting all legitimate candidates on the ballot.

How about this? Don't threaten our democracy by announcing your intention to preemptively sabotage an election to settle your personal vendettas.

Teddy, I hope you re-think this, because you are the best in this position.  On the other hand, I think you running for the Senate is great, even though we will probably steal votes from each other.   Do not make a decision rashly.

No on to the point in question.  Here is how I see it.  The law states that:

Section 4: The Department of Federal Elections
 
The duties of the Department of Federal Elections, performed by the Secretary shall be:
 1.To act in most cases as the Administrator of any federal voting booth and absentee voting booth, including for elections to the Presidency, Vice-Presidency, Senate, and any nationwide federal poll, excepting Impeachment Trial polls.
 2.To administer the declaration of candidacies for federal elections.
3.To represent the Federal Government in any federal election dispute, with such assistance from the Attorney General as shall be expedient.
 4.To provide consultancy to the Regions on matters of electoral administration and federal electoral precedent when requested by a Regional official responsible for elections.
 5.To administer a Regional election when requested by a Region, but only with the consent of the President, and with possibility of review by the Senate within 5 days.


It all comes down what "administer the declaration of candidacies" means.  It is not defined in the lstatute, so it is open to interpretation.  However, amendments appear to invalidate candidate declarations made more than two months before the election.  Thus, in my opinion, while it may argued that "administering" allows interpretation by the SOFE, I do not think so. 

Therefore the only question is whether Archangel Zero announced more than two months before the earliest possible date of the election.

Not that it matters now, but I'd hardly consider Napoleon's post a threat. He was just giving notice that he'd (rightly or wrongly) sue in the event that you didn't list Archangel on the ballot.

It'll be interesting to see if whoever administrates the election now lists Arch or not.

So, I was right in the first place?

It appears so.  However, under the law, that might not have been that important.  Quite frankly, it was a very interesting legal issue.  I do believe, that while I would not have voted for your view of your former role in the matter (if I were on the Court), the law was vague enough to support the conclusion that you could make that decision.  If the Court were to take that position, then your being right becomes more important.

Will you consider unquitting?
