The next SCJ should be someone like Alito.

^You're not a libertarian
(Pro-life and anti-SSM)

Also, does anyone know if either Jack Conway or Andy Beshear is pro-life?

I am a libertarian. I just disagree with some libertarians on those issues. There are libertarians who are pro-life and pro-traditional marriage. Most recently our voice has been carried by Ron and Rand Paul.

Unbiased got it right.

I wouldn't mind if it were to say replace a retiring Thomas or Kennedy. Scalia is really irreplaceable, but I think you need someone with a strong record as legal scholar as much as in terms of judicial philosophy simply because Scalia was such an influential force and really a bedrock in that sense and that is just as important as well. I fear Lee would be a tremendous step down in that sense.

Of course this point is all moot unless Republicans win the White House and hold the Senate in November.

The more I think about it, the more I think it is likely that he was poisoned by an assassin hired by a public sector union. Remember, the SC was likely to rule forced public union dues unconstitutional later this year .

Mitch McConnell says no replacement until January 2017.

Just in case anyone thought this election wasn't partisan enough.

I find McConnell's comments very premature.
1.) He should show respect towards Scalia's death, and not make any serious comments/decisions on anything related to a replacement until the guy is at least buried. (This goes for everyone in DC.)
2.) He should wait to see what the President does, or who he may nominate. To just say that it is a dead issue (no pun intended) until January is disrespectful to the Constitutional process & looks like complete obstructionism.

LOL. Only Dem hacks think this way.

As a Trumpist (and Atlas troll), no one takes anything you say seriously.

"yes this guy was obviously an asshole who had no problem with thousands dying were Obamacare to be repealed or innocent people being executed or throwing people in jail for having the audacity to be homosexual but we should all be sad for his death and give him respect even though his entire career was based around not giving any sort of regard at all for people who would die as a result of his decisions"

Oh the republicans are so hypocritical. If they are in the Whitehouse get the most conservative justice....but if the dems are in the white house it needs to be a moderate or they will block. Get over roe vs wade republicans, aren't you guys supposed to be for small government?

Roe v Wade is inherently a big government decision that should have been delegated for states to decide, not the Federal government, calling for it's overturning and relegating that power back for the voters in each state to decide the issue isn't being opposed to small government.

Is Gonzales v. Carhart also a big government decision?

Yes, because the federal government shouldn't have a say in abortion, whether in pro-life or pro-choice that issue should be left to the states and the people. I'm ashamed Justice Kennedy sided with the majority opinion in that case.

The founders giving every state 2 Senators was the ultimate troll job.

You clearly miss the point of constitutional federalism.

I know, I know....'muh pure democracy'.

Can't Obama appoint someone via executive order if the Senate is not in session?

Would be great if he could do so.

Would balance out the 8 years of total Obama-obstruction from the GOP.

That probably only applies to ambassadors and secretaries. I obviously watched too much House of Cards, when Frank Underwood nominated his wife to the UN after the Senate voted against her. But even if Obama could do it, it would only offend congress.

If you want to have some fun, look at the comments on FOX News and Breitbart. They seem to completely seriously believe that Obama murdered Scalia.

If Dems get this pick, Sri Srivasen will restore the voting rights act which will hurt the GOP, especially in 2017-2018 whenvoting drops among Dems. Nevertheless its a setback for concealed weapons carry and campaign  finance reform on the part of conservatives.

Justice Kennedy was confirmed by the Senate during Reagan's final year in office and it was a Dem majority Senate....just saying.

Were the Democrats at the time as partisan as the Republicans are now?

It will help Clinton, as she is perceived to be most likely to win and unite the Dem party. A sign at Mondale's 1984 campaign said "Save the Supreme Court. Vote Democratic." We can expect something similar this year, assuming Scalia is not replaced this year.

That's a very nice thing to say and wish for - Clinton going the way of Mondale. It's a beautiful thing.
