A BILL

To prohibit workplace discrimination

Be it enacted by the Assembly of the Northeast Region convened


SECTION 1. TITLE

This legislation may be cited as the Northeast Discrimination in the Workplace Ban Statute of 2013 or the NDWB.

SECTION 2. PROHIBITION OF WORKPLACE DISCRIMINATION

1. Employment of persons shall not be denied or abridged on account of race, national origin, religion, gender, or sexual orientation.

1a. "Transgender" shall be included as a similarly illegal basis under the definition of gender, of discrimination or denial of legal rights.

2. Any employer found guilty of violation of section two shall be fined no more than $5,000 per employee (or prospective employee) unlawfully denied employment, in addition to whatever damages a Court may award the employee (or prospective employee).

The need for this bill should be self-evident.  Currently, there are only 16 states in the US where you can't be fired for being transgender.  While workers are probably already protected for their race, national origin, sex, etc. in the Northeast, I have found no law on the wiki that prohibits mistreating transgender employees.  This bill will extend protections to all classes of people and prosecute businesses that are found to deny employment to people on the basis of their physical/psychological traits.

Would this bill result in businesses being sued because they don't have separate bathrooms for transgender people? Having to add bathrooms would be a big financial burden to many businesses.

I support this bill. But isn't 5000 dollars a bit low as penalty? For a small company it may be a lot, but bigger companies earn 5000 dollars in minutes, if not seconds.

I support this bill. But isn't 5000 dollars a bit low as penalty? For a small company it may be a lot, but bigger companies earn 5000 dollars in minutes, if not seconds.

What amount, in your expert opinion, would be most appropriate?

No.

I don't think so.  I don't recall hearing of that problem in states where these laws are on the books.  Also, this law only pertains to employment.

You could make the equation amount of penalty/company revenue. A bigger company will pay a higher fine.

It could be by percentage of revenue of the previous year. For example 1% or 2% of the revenue. And it could be increased if companies do this more often.

I agree with the increasing part, but 1% is alot to a huge company, but a smaller one might not. I think my log idea is to lenient on large corps, but I feel like someone shouldn't get only a few hundred dollars in one case and millions in another depending on the size of the corporations.

You may be right, but it might also prove to serve as an example for the company and for other companies. Pay a million dollar fine and you will think twice about doing it again.

But the bigger fine could also be included in the damages awarded by the courts.
