As an attacker, yes you can.  It would allow you to only place 1 battalion in the conquered state, should you so choose.

All three in New Mexico, attack Arizona and leave 3 behind in New Mexico, attack Nevada from Arizona and split the remaining forces equally between Nevada and Arizona (if there's an extra leave it in Arizona)

Question for future reference: Do we have to trade in once we have five cards? And if we come into possession of more than five at the end of a turn due to conquering another player, do we have to trade in on the spot?

#1: Correct.

#2: Not on the spot, no.  You just keep them until the start of your next turn and then have to trade in as many sets as necessary until you have less than five cards.
