If a case was thrown out or he was found not guilty, then he shouldn't be accountable for it and it shouldn't be used a smear against him.

Yep, and the e-mails. In our justice system, if someone is found not guilty, their life shouldn't be negatively effected in any way and they should be compensated for financial strain and emotional difficulties suffered. That's my belief anyway. But then I've seen a number of frivolous or false lawsuits threatened or enacted in my day so I'm pretty jaded.
