Did you hear my proposal?  The one judge would have to be approves by at least a 8-2 margin in the Senate.  He would have to be revoted on every two month (at the start of each congress) and the president can petition the Senate ot remove him.  If the Senate approves by at least 7-3 then that person can be removed and another person nominated to do it.  Every new president will be allowed to appoint his own justice and if he gets the votes the old one will be removed and the new one installed in his place.

I disagree with this proposal on several grounds:
- A single person, no matter how approved, would have a significant amount of power.
- Judicial appointments would be very politicized, and independence restricted.
- Senators might not be willing to agree on one candidate, and the previous officeholder would stay in office for a lengthy period of time.

Instead, I propose the following plan:

Three justices be appointed by the President, with the advice and consent of the Senate, for six-month terms, except that for the first three appointments, one judge's term expire within two months, and the second expire within four months. A new justice would be appointed every second month.

With minor changes I'd have to agree with my collegue and the distiginused Gentlemen from Emsworth from New Jersey

our (progressive) orignal proposal

Section 1
The Judicial power of the Forum, shall be vested in one Supreme Court of 3 persons. The Justices shall hold their offices during good behaviour.

Section 2
The Justices of the Supreme Court shall be appointed by the President with the advice and consent of the Senate. The President shall be able to replace a Supreme Court Justice in each term, not withstanding any Justices who may vacate their seats willingly, however, each Justice shall be able to serve a minimum of eight months before replacement.

Section 3
The Supreme Court shall be responsible for maintaining an up-to-date register of voters and shall be the arbiter of all disputes concerning elections.

The three membe4rs should be appointed as such:

1. Appointed by the President
2. The runner-up in the Presidential election, or their representative
3. The Game Moderator

That does seem odd...will it be possible to hold anotehr office when you're a judge? If not, people might not be that eager to get those positions...

Lifelong term may be a bit too much....and under my constitution...no one can serve two positions at any given time......I think the Justices should be in as long as the President desires.......

What will be the specific duties of our Supreme Court? Also yes 3. We don't want too many I think, especially for such a relitively small group.

The duties of the Supreme Court is to pretty much keep order at the forum.....the last election we had....many people complained about this and that....and I want it done this way....and we want it done thata way....hopefully the Constitution will set forth these rules....and the Supreme Court will step in on any occasion in which their is a dispute.

In my current draft of the Constitution....these are the duties of the Supreme Court.

Article III
Section 2.
Clause 1. The Supreme Court shall step in on any occasion in which a person or persons preform an unconstitutional or unlawful act.

Clause 2. The Supreme Court may make any ruling they see fit to uphold the Constitution of the Atlas Forum.

Clause 3. The Supreme Court may only interpret the law, and if they pass any ruling that bypasses congress’s lawmaking, they are guilty of abusing their power and therefore subject to impeachment.

Five judges would make things more interesting.

As far as the term for a Supreme Court Justice.....MAS117 and myself and discussed this possiblity.

First of all...I hope you all know that ALL Presidential appointed positions must be met by Senate approval. If the President wants to fire a person he appointed.....he may do so without Senate approval......EXCEPT the Supreme Court justices.

In order for the President or newly elected President to remove the Supreme Court justices.....he must have attained Senate approval....

What do you guys think of that?
