If the honorable Pres. Duke is correct (and I'm sure he is), I don't think Justice Torie should be impeached over this. He's a good man.

This is the post he is talking about I think.

When one is in lock down studying for the Bar exam in NY about 10 hours a day, every day, while expected to service clients now and then, eat and sleep, and screw, and manage a ton of real estate, including managing from afar some substantial construction activity in Hudson, along with completing my delayed 1031 exchange and the sale of one leg of that transaction (thank heavens the sale of the house in Oregon that was part of the exchanged closed before the 180 day deadline), one I suppose could deem debatable as to whether or not one is alive, at least as to the issue as to whether that life is on Earth or in hell, but whatever.

You see, I mean, sure I have been a lawyer since rocks cooled, but does that mean that I know that a party admission by convention as to the Federal Rules of evidence is call "non-hearsay," even though it is hearsay (yes, I already knew that lucunae), but in the state of NY and its courts it is called hearsay but is admissible as an exception to the hearsay rule (as it should be, good for NY), and that a few states have the "agency" theory of felony murder, so that when a cop kills someone in the course of a felony, the perps are liable for that typically in most places, but not agency theory states because cops are not agents of the gang of perps the way an accomplice is if   the trigger man in their gang? F no, and the damn Bar Exam test delves into all of that. Sh*t sometimes you need to know four "languages" at once, the Model code rule, the majority common law rule, the NY rule, and the Federal courts rule. Just ducky baby. And then of course "they" (as in the the sadistic 60 year old committee of law professors who design the test with the aim of attempting to trick you any way they can so they can get a good "curve" of Bar Exam results), expect you to know all the time deadlines and means of alternative service where and when, and whether in is in state, or out of state, as to service of process in NY, as if your goal in life after passing the Bar was to become a full time process server. Boo! F them.

So I won't be around again until August - at all. You all are just are not as important to me as eating, sleeping, screwing, avoiding legal malpractice and massive financial waste - and yes, passing the NY Bar, and passing it the first time now, as in July, rather than later. Don't mean to hurt anyone's feelings, but that is the way it is. Heck I don't even know what has been happening politically, except with respect to some vague rumors that Iraq is falling apart, and Joe Biden's idea of partition back when may have been inspired genius, and that Thad Cochran got a sudden electric shock and miraculously arose from the dead refuting every law of gravity and nature that we thought had been so settled, that a judge could simply take judicial notice of it all.

And as a notice to the Cave, please have someone else attend to all my little reports stacking up. I just won't be dealing with them for about 35 days. And be kind. When in doubt, the Torie policy is "no action." Being a high school Vice Principal type running around with a paddle just isn't my thing.

Mideast: An Ohio amusement park ride that swings riders as high as 125 feet has been closed indefinitely after a cable snapped, injuring two visitors.

Cedar Point spokesman Bryan Edwards said a cable on one of the Skyhawk ride's carriages disconnected late Saturday. One rider was treated at a hospital and released. The other person was treated at the scene, the park said.

Northeast: A family of five, including three children, were found shot to death Sunday inside a southern Maine apartment, authorities said.

Investigators said a gun was found near one of the bodies, and it appeared that no one outside the family was responsible for the shootings.

State police Sgt. Chris Harriman said murder-suicide is one of the scenarios being investigated but that a determination will be made by the state medical examinerís office.

Pacific: Wildfires broke out in the summer heat, including a wildfire that has destroyed 13 homes and forced hundreds of evacuations in the Sierra Nevada foothills, while a fire near Yosemite National Park that destroyed one home grew significantly overnight.

IDS: A man attacked another man late Sunday night in Jacksonville, Florida, leaving the victim in critical condition. Police say that the attacker was under the influence of "bath salts", a synthetic drug. The man was left with half of the skin on his face missing after the attacker ate it off of him as he screamed. This is the second time we have seen a Florida man on bath salts eat the face of another man. "When does it stop?" Rebecca Williams asked. "The zombies are out to get us."

While obviously Democrats are a bit better at standing up to Wall Street, there are some pretty anti Wall Street Republicans who might consider voting for Democrats if they ever took a real stand against Wall Street.

I doubt it.

Democrats have no incentive to go against Wall Street, because it loses them lots of funding while gaining little to nothing in return. The only vaguely "populist" element currently within the GOP is the Tea Party, and good luck getting them to vote for any Democrat.

DUI convictions up nearly 50% year to date

Following January's reduction in legal BAC levels to 0.05% for all drivers, record numbers of DUI convictions have left many Atlasians in difficult situations. Fred Jones of Paterson, New Jersey said "I only had two beers before driving- I was not putting myself or anyone else at risk." Fred said he was pulled over for expired tags when asked if he had been drinking. "I was honest about it. Two beers is not going to cause problems for me when driving." Fred was forced to pay a hefty fine of $1,750 and had his license suspended. "How am I supposed to get to work now? Two beers man! This is crazy." Amy Carter of the National Public Transportation Association says that "Regardless of whether the change was right, it's clear that we need to enhance our public transportation so that Atlasians are not so dependent on their automobiles." A MADD spokeswoman said "Our children our safer because of this law. If someone has anything to drink, they should not be driving, period." The number of DUI convictions is up 48% compared to this time in 2013.

I am kind of mad at my governor Jay Nixon for vetoing concealed carry for teachers in Missouri.  I think all teachers should be allowed to carry guns to defend the children in the school.

You can't allow teachers to carry guns and continue giving them tenure at the same time because then its impossible to get rid of the crazies.

It's considerably better than American Budweiser. And it's usually about the same price. So freedom beer obviously.

But it's still the Belgian Budweiser....given the available alternatives among Belgian beers.

That said, given the outstanding American microbrews out there....the existence of American Budweiser is similarly difficult to fathom.

America is full of people with poor taste and lots of money.

Thanks Winfield! I'm not yet feeling better but I will be posting things today. I'm near motionless from exhaustion. I've fallen asleep drinking energy drinks twice this week. Every joint in my body aches and I keep losing my train of thought. Still working six days a week when I'm used to three or four. Ugh.
