Not surprising.  It's pretty clear that the court would've had to have challenged the validity of Roe v. Wade and Planned Parenthood v. Casey had it wanted to uphold the law.

Agreed.  While I think both cases were badly decided, lower courts don't get the privilege of overturning the Supreme Court.  I don't see this court as wanting to revisit the issue now so assuming North Dakota appeals all the way up, I expect SCOTUS to deny cert.
