Based on the following information, I think the case is made for the FBI recommending indictment:
(1) There was at least one email message on the server which contained highly sensitive SAP information; (2) There was at least one email message on the server whose header indicated that it contained sensitive information, with evidence of a recommendation to remove that header before forwarding the message on, providing a clear example of the willful mishandling of sensitive information; (3) The server contained more than Hillary Clinton's "personal emails" (see items 1 and 2 above), and deleting the contents of government emails would appear to constitute an obstruction of justice; (4) There was a clear attempt at circumventing specific laws pertaining to governmental transparency, freedom of information access, maintenance of an archival record, etc. (5) Interested parties within the State Department were not consulted about whether use of a private server was allowed;
These items are what have been reported; the FBI is undoubtedly privy to information which the general public knows nothing about. I can't imagine the above facts not justifying a grand jury looking into things.
