A Texas congressman and distinguished USD alum faces DWI charges. U.S. Representative Kevin Brady was born in Vermillion and received a degree from the University of South Dakota in 1990.

Brady was back at USD as one of six former students receiving an Alumni Achievement Award. His homecoming visit ended in jail Friday night.

Highway patrol manpower was beefed up for homecoming, but Brady wasn't stopped at a checkpoint. He was arrested just before midnight during a regular traffic stop just 100 feet from his hotel.

"The type of violation that we stop for literally hundreds of times each year," says highway patrol Capt. Jeff Talbot.

At 11:45 p.m. Friday, a highway patrolman pulled him over on Highway 50 for having no taillights. But the officer arrested him for something more serious. "The driver was tested and believed to be under the influence and was placed under arrest for DWI," Talbot says.

"I never imagined I was anywhere close to the legal limit," Brady says. "But the fact of the matter is, getting behind the wheel in any circumstances is almost always a bad decision."

Brady's serving his fifth term in congress, representing the Eighth District of Texas. This is his first drunk driving offense and he acknowledged he made a mistake. "No one is above the law," he said. "I take full responsibility for my actions, and I am glad law enforcement is doing their job."

Brady failed field sobriety tests, but he refused to take a blood alcohol test. If he's prosecuted under South Dakota law, he might not drive again for a while.

"In South Dakota, that refusal to taking the blood test could read to a year's suspension of your driving privileges," says Talbot. If he's found guilty, Brady could face up to a $1,000 fine and a year in jail.

There was wine served at the alumni dinner, but that ended at 8:30 p.m. Anything Brady did between then and 11:45 p.m. when he was stopped was not affiliated with the University.

Brady's first court date is scheduled for November 8th, but he does not have to appear in person.

Brady represents a large CD on the LA border and is oppose by a guy with a non-serious website who was affiliated with the Greens. Doubtful he is seriously contested.

TX-8 is an absurdly safe GOP district; while since 2004 it's stretched out to a rural area on the LA border (with a lot of Dixiecrat types), politically it's still dominated by ultra-Republican Houston [outer] suburbia. IIRC Jmf lives in the 8th.

Lol. I doubt he'll have to go to jail though. Nor do I think he at all deserves jail.
As to reelection...no danger in the general. Possibly in the primaries.

It won't make any difference.  As stated before by Al, this district is ultra-GOP Houston suburbs (Montgomery County, moving up into Huntsville and Walker County along I-45) and some east Texas rural areas.  The far east Texas rural areas have some Dixiecrat histories, but those are dying out as the Democratic party continues its leftward drift.

Interestingly, Montgomery County was Bush's largest win (78%-21%) in 2004 in a county with over 100,000 votes, and the county provides roughly 1/2 to 2/3 of the votes in the CD.

And even if he doesn't run, the GOP will just find another candidate to win here.  There are plenty of them.  If someone in the GOP wants to challenge him, they might, though I doubt their voting records would be any different.

In fact, I don't believe the Democrats haven't even bothered to run a candidate the last 4 elections, and Brady's won over 90% of the vote all four times.

It doesn't hurt his re-election chances.  Bush took over 70% here in 2004.

That's only outside Utah.
Good call! Bush got 86% in Utah County, Utah(metro Provo).  What a scary place!
