Obama may think that with her apparently good-natured and affable personality she will manage to persuade Kennedy to join the liberals more frequently. But then again if she failed miserably to do exactly that as Solicitor General, I can't see how she will manage it as a Justice.
Not to mention that Wood had a proven record of actually persuading conservatives to join her opinions.

Now, now, be fair. Kagan has showed she's able to presuade conservatives to go with her oppinion. She even managed to get Alito to agree with her on dog fighting videos. (It's apperently the liberals, the moderate, and some of the conservatives that is harder to convince.)

I imagine it was in Obama's mind. It makes a difference in what otherwise seems like too safe of a choice. It's a historic nomination, although only if she eventually comes out. I'm sure there were closeted justices before.

I'm sure you'll see him on the news soon and perhaps he'll explain his glee.  I was just reading into an article I just read.

Here is a clip from a recent article:

Judiciary Committee Chairman Patrick Leahy of Vermont called Kagan, 50, a "superbly qualified candidate" who would "obviously" be confirmed this summer before the chamber leaves for a monthlong break. His panel will hold Kagan's confirmation hearings.

In replacing Justice John Paul Stevens, Obama would also be breaking with tradition. Every other member of the court is a former federal appeals court judge, and Kagan has never served in the judiciary. The last time a non-judge was appointed was 1972, when President Richard M. Nixon nominated William H. Rehnquist and Lewis Powell in the same year.

If anything, appointing someone who is not a former federal appeals court judge is a well needed restoration of tradition, not a break with it.

I'd have preferred Wood but lets not pretend that their voting records would be substantially different.


Kagan is deferential to executive power.  Wood isn't.

Kagan has a remarkably blank record.  With Wood, we know what we're getting.

Oh, I completely understand why Obama picked her.  But why does everyone else have to roll over?  President Bush wanted to appoint a political hack and conservatives fought that nomination.

I also find it funny, as Glenn Greenwald notes, that Democrats are afraid of appointing someone as liberal as Bush's nominees were conservative, as if they are afraid of their own interpretations of the law.
