Since the Bacon King incident, there has been a lot of discussion regarding what the Senate rules mean and how they should be applied.  There was even a constitutional amendment proposed, which failed.

Here is how I see it: according to Senate rules, after 21 days of no Senate activity, that person's seat is deemed vacant by the Senate.  As this rule is part of Senate procedures, and not law, it is deemed vacant for Senate procedural purposes only.  So when votes are counted and the inactive Senator doesn't vote, his lack of vote is not counted towards the total.  Thus the number of votes needed to achieve a majority is that much less.  Normally 5 votes would not constitute a majority, but in this circumstance it would.

However, the Senate most vote to expel the inactive Senator in order for the seat to be deemed legally vacant, requiring a special election or appointment to re-fill.


In the current situation we have 9 Senators, Libertas having been banned.  Now Barnes has been inactive for more than 21 days, so procedurally his seat is vacant.  So we have 8 Senators.  BUT if Barnes returns before his term expires, and resumes activity in the Senate, nothing prevents him from doing so.

Is there no basis in the Senate rules for allowing a declared leave of absence? Unlike BK going AWOL, Barnes announced his absence and has as good a reason as possible (illness). That may be a reason to resign voluntarily or be voted out if one runs for reelection anyway, but surely isn't a reason for being thrown out of the Senate?

I realize this matters little in Barnes's case with the election looming and no move to expel him/"declare the seat vacant", but this is important for future reference.

The problem is that he appearently posted in the Senate a few days after posting the leave of absence so there is a wild card, especially with a vague LOA as to the length of its duration.

There was when written a clause excepting declared leaves of absence from counting towards declarations of vacancy. I can't speak as to whether any changes were made subsequently to remove that section.

Agreed. On top of that, he has been pretty active on Facebook with updates and such. If he was actually too sick to get on Atlas, I'd imagine he'd also be too sick to get on Facebook.

I'm glad he's okay, though disappointed he seems to have suddenly left without saying a word...

I feel the same way. Barnes was a particularly nice person and I'd be really surprised to see him leaving the forum without telling us.
