The Assembly will now consider the legislation introduced by the Representative from NY.  Debate will last 72 hours.


Northeast Dog Control Act

1. It shall be unlawful for any owner of any dog in the Northeast Region to allow such dog to:
  • A. Engage in habitual loud howling, barking, or whining or otherwise conduct itself in such a manner so as to unreasonably disturb the comfort or repose of any person other than the owner of such dog;
  • B. Chase, jump upon, or otherwise harass any person in such a manner as to cause intimidation or fear or to put such person in apprehension of bodily harm or injury;
  • C. Chase or run alongside of motor vehicles or bicycles while on a public street.
2. Any person violating this law shall be fined $100.00 for a first violation, $200.00 for a second violation within sixty months, and $500.00 for a third violation within sixty months.

How is this supposed to be enforced?  Shall we have the Dog Police install CCTV cameras in the home of every dog owner?

If someone sustains injuries or damages due to another's pet, then that is currently a tort that can be litigated in civil court of law.  Criminal activities that involving a dog are already covered under criminal negligence or assualt laws, while infractions such as excessive noise are covered under municipal noise regulations.

I see no need for this bill, and I worry about opening the can of worms of making civil torts criminal and over-broad language that could lead to unreasonable prosecutions (not that our wonderful criminal justice system would ever unreasonably prosecute anyone).

I find myself in agreement with the honorable member from New Jersey.

All of the issues raised in this bill should already be covered by noise bylaws, civil cases, etc.

If dogs run rampant, they should be picked up by the local dog pound or enforcement agency.

Owners should be charged by the responsible jurisdiction for dog violations.

I will not be supporting this bill.

Debate time has expired.  The Assembly will now vote on the final text.  This vote will last 24 hours, or until all Representatives have voted.
