They now support gay marriage by margins that overwhelm the Bradley effect.

True, Field polled 51-42 support in 2008 when Prop. 8 passed by 5 points. But they just polled 59-34 support. Gay marriage will be a settled issue in California once the electorate votes.

There is an initiative in the signature gathering stage to be on the November ballot, I don't know how active it is.

Cool story. Too bad gay rights groups in California are amongst the most incompetent.

The people have already spoken. They have banned it. The Federal judge had no jurisdiction.

Kindly take your tilting at Marbury v. Madison elsewhere.

A new poll shows gay marriage has arrived in California in public opinion if not in state lawbooks.

Golden State registered voters now favor same-sex unions by 59 percent to 34 percent, a 25-point gap that is the largest margin of support for the issue in the three-plus decades the Field Poll has been asking the question.

The new Field survey shows support has leapt markedly in the three and a half years since California voters approved Proposition 8, which banned gay marriage, 52.3 percent to 47.7 percent.

I believe this (http://ballotpedia.org/wiki/index.php/California_Right_of_Same-Sex_Couples_to_Marry_Initiative_%282012%29) is the cleared initiative, but it doesn't seem too active. Maybe because of the recent Prop 8 appeals. We'll find out by May 14 if it made the ballot.

A California "Civil Marriage Act" Initiative (#11-0058) has been approved for circulation in California as an initiated constitutional amendment. To earn a spot on the state's 2012 ballot, sponsors of the initiative must collect 807,615 signatures.[1]

The 150-day circulation deadline for #11-0058 is May 14, 2012.

So this would make a second vote on the issue illegitimate... how, exactly?

71% support among single/never married. Well there you go, what more proof do we need. Gay-marriage is clearly a plot by jealous single people to destroy marriage.

Why did it fail in the first place.

Did you read my posts? I said gay rights groups in California are incompetent. They allowed the other side to define the issue as teaching gay sex to kindergarteners, and not about how it affects regular Californians and their rights. "Vote no because... it's bad!"

They did seem to handle it poorly, but on the other hand, it's an effective attack that is hard to parry. It would be nice if our opponents didn't go there, but all's fair in love and war, and appealing to fear that we're going to make their kids gay is an effective way to keep us from having the protections of the law that they take for granted.

Why did it fail in the first place.

Prop 8 proponents reached out heavily to minorities who otherwise vote Democrat. They were advertising on progressive radio for example with a voice which had a slight latina accent. And of course it was all lies about teaching gay sex to little kids and other such crap. The no on 8 folks on the other hand didn't bother with that and just assumed just because they voted Democrat, they would vote for gay marriage as well. Big mistake since I think young latinos, those who would have young kids, are a key swing demographic on this issue.

The pro-Prop 8 ads were totally full of lies, but in American politics, lies work. I remember one that said gay marriage would be mandatory. That's right, if you didn't pass Prop. 8, you'd be forced into a gay marriage. Some of Romney's money went to the Prop. 8 campaign.
