The US Supreme Court has upheld the individual mandate at the heart of President Obama's healthcare law as constitutional.

No, I can't have Kennedy as a loser on an important vote. My main premise that the court is arbitrary, random and capricious hinges on the fact that whatever Kennedy wants he gets.

According to the majority the act successfully framed the penalty for uninsured individuals as a tax based on one's income. They then cited cases to support their contention that the failure of Congress to call it a tax was no reason for the Court to not call it what it really is.
