Wow. I guess I've been misinterpreting that law all those years. I've always set the deadline for candidacy declarations for Senate elections to be 00:00, Thursday.

The election has always begun 00:00 on a Friday, so it made sense for the deadline to be 24 hours before the actual beginning of the election. I prefer to do that rather than set the deadline to be 24 hours before the theoretically-possible-but-inconceivable start time of 00:00 Thursday.

So are they on the ballot or not, beacuse if they aren't that could have legal repercussions for years past with laws that were determined by one or two votes.

I will put them on the ballot. This is the way I've always done it and it's what people expect: inclusion over exclusion.
