Well a majority of the Senate didn't like it though. Theoretically, one could look through the objectors and recraft the offending clause in a way that gains their support.

The concern was that the thing banned campaigning (which for the Fezzy crowd, that would meet with tremendous approval), and with a more specific text that concern can be alleviated.

With five votes in the negative, this has failed. It is a shame really, because had three been edited, it probably would have passed. On the other hadn most of this is symbolic. To the extent that any of it was not, we should work on passing bills to address those issues going forward as this is a very serious matter to be sure.
