They argue that Lawrence doesn't apply to minors, and the girl in this case was 17 apparently. (link)

i don't think gay behavior should be outlawed, even though I think it is a sin...but does this law forbid anal/oral between a married heterosexual couple?  if so, what is the justification for calling such acts even a sin?

It doesn't matter. If the Virginia statute bans these acts regardless of age, it is overbroad and inherently invalid regardless of the specific of the cases.

I think what Cuccinelli's getting at is the same thing that certain people were getting at pre-Lawrence when they were hoping that the SCOTUS would overturn bans on homosexual sodomy only on equal protection grounds but allow bans on homosexual and heterosexual sodomy alike (which several states had) to stay in place.  The idea is "if we're banning anal and oral sex for straights and gays alike people can't sue on the basis that we're discriminating against gays."  If SCOTUS didn't buy that in 2003 the Courts aren't going to buy it now.

Except he seems to actually believe that this unconstitutional, ludicrous, unenforceable except selectively for the government to punish those it does not like, and offensive, statute, has merit.
