Civilian trial, of course.  Calling him an enemy combatant and trying him in a military tribunal would be the single most dangerous threat against due process for potentially every citizen since the Civil War.  I doubt it would hold up in court, but then again, the SCOTUS doesn't act rationally on these types of issues during times of crisis (with the exception of Scalia, and Stevens when he was still on the Court).

Labeling the bomber an "enemy combatant" would completely remove any real definition that that phrase currently holds and would be a whole lot more dangerous than hypothetical drone strikes on citizens.  Anybody pushing for military tribunals needs to take some serious time to think about the logical ramifications that that move would have.

There's absolutely no question.  The guy is an American citizen entitled to due process of law.

And even if he wasn't an American citizen, it doesn't matter.  The 5th amendment is specifically worded to cover any *person*.  If I go and commit a crime in the UK, I am subject to the UK system of justice.

My favorite are people like my dad who believe he should be an enemy combatant because of "special circumstances" in the case, but absolutely opposes hate crime legislation because "a crime is a crime"

The cognitive dissonance is maddening.

Well, this poll is now moot -the White House has decided NOT to try the Boston Bomber as an enemy combatant, and his Miranda rights have been read to him.

The fact that he is even considered to be handled as an enemy combatant is only because this guy is a Muslim and has a hard-to-spell foreign name and is not named Frank Johnson from Hicksville, Arkansas (a Christian) etc.

Exactly. Are these people complaining that Timothy McVeigh was tried in civilian court/

Because Tsarnaev is not actually affiliated with any foreign government, there is little doubt in my mind that Tsarnaev is to be tried as a U.S. citizen. In any case, it seems this will occur anyway.

Slender 19-year-old brunette with a nice complexion and apparently good with his hands.  I can imagine many prisoners fighting over this guy.
