Married same-sex couples with children may face higher bills from the IRS as recent Supreme Court rulings start playing out in the tax code.
The increase probably would result from phasing out income tax credits for families, depending on the distribution of income between two working spouses, now that same-sex couples will be required to file joint returns with the Internal Revenue Service, according to a Congressional Research Service report.

I guess now that DOMA is gone, high two income LGBT couples now will face the same marriage penalty that I and many other high income couples face.  I guess equity will come with a price (in this case extra taxes).  I always dreamed of having a fake divorce with my wife yet live togeather with our child.  We will save many tens of thousands of dollars.  But the social cost would be so too high in terms of work, school and personal life aside from the fact that my wife will not agree to a scheme like this anyway, even though she is quite an utilitarian like myself.  For now it is just a dream that i drool over the the money I can claw back from the government.

Yes, I'm not sure what the impact will be on me. My partner and I have comparable incomes so our taxes will definitely go up on that count, but I will save more than $1,000 annually on income taxes on health care benefits. So, worse for him. Wink

It would depend.   Somtimes equal income leads to marriage bonus or penalty depending on what that income is.  The way AMT and the marginal tax rates works relative to filing as joint or seperately is the biggest factor in my view.  See

Perhaps it applies to an EITC penalty instead of bonus?

Much more substantially, the tax laws favor people with children. Parents, whether needy or not, are the real welfare queens. And I don't really have a problem with that. I think the nation should go the extra mile to help households with children, but I wish people were more grounded regarding who is taking money from the government. Perhaps we should have a debate about whether parents should have to take a drug test in order to claim the child tax credit.
