I'm confused- did Xahar resign or didn't he?

I, Xahar, do solemnly affirm that I will faithfully execute the office of Senator of Atlasia and will to the best of my ability preserve, protect and defend the Constitution of the Republic of Atlasia.

Also, where did Hashemite appoint a replacement?

For the record, I have no record of Hashemite de-registering.

As chairman of NMAM, I appoint Xahar to fill the party's vacancy in the Senate.

He resigned. In any case, I would have motioned to waive the minimum debate time. Whatever.

EDIT: And he's back

Minimum debate cannot be waived here.

1) There is no limite on Explusion set by the Constitution save for it having a 2/3rds vote in favor to do it.

2) The Rules do not stipulate anything other than the length of absence necessary to allow for such.

Frankly, I don't see anyway that resigning and getting reappointed would shield one from this process. I posted the rules above and I can assure you the only limite in the constitution is the vote majority requirement.

If I'm expelled, I'll just be reappointed again. You can try to proceed if you want, but it won't do you much good.

Well perhaps that would compensate for all the near misses you had over the past three months in that case.

That just makes no sense, you guys are just f**king around.

What about it makes no sense? I resigned, creating a vacancy that it was Hashemite's task to fill. He did so.

With 72 hours of debate having elapsed, such is now closed and a vote commenced on the question of whether or not to expell Senator Xahar. This will required a two-thirds to vote in the affirmative and will run for 72 hours or until enough votes have been cast in favor or against it.

A vote is now open on the motion to expell Senator Xahar, Senators please vote Aye, Nay or Abstain.

Maxwell, please change the topic to indicate a vote is ongoing here.

AYE

There has been no desire to improve and instead an attempt as been made to circumvent and undermine this process. The Senator was absent from a period extending beyond seven days without a leave of absence and furthermore has exhibited "demonstrative proof" (couldn't resist Tongue) that possess no desire to serve the citizens of Atlasia who elected him back in August, and thus in my view, is thus clearest case for expulsion I have ever seen.

I would question the legitimacy of this process, as its purpose was fulfilled upon my resignation (in every case where charges of expulsion have been brought against a member of the United States Congress who subsequently resigned, no vote on expulsion was held), but the point is moot since a vote to expel would inevitably be followed by my reappointment to the Senate. This is a futile effort. I cannot be removed.

A reluctant Aye, only because I remain unsure if this is legal.

How is it not legal?

There is no limit set on expulsion in the Constitution other then 2/3rds of the Senate. So Constittuion is fine with this.

The rules, when we started this process, required a seven day absence. Xahar was absent for seven days, no?

There is nothing to indicate that so blatant an attempt to subvert the process by resigning and then getting reappointed renders this process illegal or against the rules. There is no mention of a reset on the seven day rule and as long as he is still Xahar, he is thus subject to expulsion.

Keep in mind also that just being eligible for expulsion doesn't dictate that such be actually done. That is up to the votes and the presence of the restrictions is there to prevent abuse. I have pondered myself what situations would I vote no and there are some. If a computer failed and he had gotten back on day nine or whether I would probably vote no. There is no time limitation on the eligibility, I would point out. But no one would vote to expell Barnes or BK if they were to return at some point for instance unless that transgressed again. Even though it is just a restriction on usage thus the time absence restriction has become a measurement of deserving such when casting the votes. The evidence so to speak.

This expulsionbis obviously illegitimate and affront to our democracy.

Keep in mind that I rejected calls for expelling both Xahar and yourself several months ago precisely because it was against the rules though for both it would have been justified and I would have voted for it once the rules did allow for it. The rules are there and to be uniformly applied regardless of bias to protect the members and ensure each gets a fair and equal treatment. If I had any doubt about this proceeding, I would have stopped it.

Nay

This is an illegal, bulls**t witch-hunt of a vote. The fact that you all are ready and willing to expel Xahar but weren't about to expel a much worse Senator (Napoleon) accurately explains the pathetic approvals this Senate gains in the opinion polling.

I know you like to play games with the Senate, but the fact is I have lobbied the Senate to remove both of these gentlemen for quite some time. The fact is, both have dodged the Senate's expulsion requirements, and Xahar, unlike Napoleon, wasn't as crafty or didn't care enough. I care about the rules of the Senate, you only seem to when its to your benefit.

I would have supported a similar vote on Napoleon had he not resigned when he did. I think Gass also deserves consideration for an expulsion vote, although at this point I don't see anything beneficial from expelling him.
