There needs to be a great deal of caution exercised in the laws defining sex crimes. If an 18 year old boy has consensual sex with his 16 year old girl friend certainly he should not get the death penalty or life in prison. Also as I understand it some states, in an effort to prevent kiddy porn, have passed laws against photographing nude children. That may sound reasonable on the surface, but how reasonable is it if you end up jailing parents who took innocent pictures of their kids playing in the bath tub? Obviously we don't want to do that either. On the other hand if an adult abducts an 8 year old girl and has forcible sex with her we should throw the book at him. I would support the death penalty for that.

My problem with 3 strikes laws is that the punishment does not go far enough.

I would give the person a mandatory appeal on all 3 convictions.  If they lost all three I would gather the entire prison population together and execute the repeat offender in front fo them and tell that that is the punishment for recidivism.

Speaking of thought process- YOU HAVE NONE!!!!  You automatically think toughest punsihment possible without thinking of any ramifications or poor reason for doing so.  Granted do you think a 19 year old guy that had sex with a 15 yr old girl should be thrown in jail FOR LIFE??  Hell no.  He may not have known her age for she may have actually looked older than him!  Ever think of that?  Of course not.

How do we solve that problem Flyers, not by setting an arbitrary age.

No, but child molesters should get 20 years to life, no parole, depending on the severity of the case.  20 years for say a 27 year old and a 14 year old.  A 47 year old and an 8 year old should be life in prison. 

Flyers, who cares the age.  The fact is the girl was molested by someone older than her.  That alone deserves life, no parole.

Says who?  Surely you have to judge the situation.  Megan's Law should not have to be created.  A person should be in jail until he is rehabilitated OR a menace to society, in which case he shoudl be locked up, throw away the key.  There shoudl eb no badge of shame outside of jailtime.

Without that "badge of shame," it would be harder to find the creeps responsible for these acts.

If they do eventually get out of jail for some stupid reason, then I agree with wearing an ankle bracelet, and a sign on their home (large) and something on their license plate.

They should also be banned from going anywhere that a large amount of children without their parents are likely to be. Schools, libraries, parks etc.

The answer is, if one feels one must have the State interfere in consensual sex, is at least set a more reasonable age of consent - say 12 or 13.
