Based on a quick summary of the Circuit Court cases that deal with similar issues, it seems like only the Fourth Circuit would not allow this regulation.  I'm fairly confident that the Court will rule in favor of the prison.  A unanimous decision wouldn't surprise me, and I think that's most likely;  I would be shocked to see anything closer than a 7-2 decision.
