having a specific law is probably an invitation to frivolous lawsuits.

How so? Do you mean that someone takes a picture without ill intent, and it happens to show underwear/buttcrack/cleavage/etc., and that person sues?

Pretty much, yeah. BRTD's post led me to vote Aye (R ), but I'm still not 100% sold.

As a rule "upskirt" photos involve placing a camera where one would not expect there to be one, not someone snapping a pic of a lady whose skirt gets raised up than it should by some misfortune.

In principle, there should be some sort of legal prohibition for this sort of thing. I don't know whether criminal prosecution as opposed to civil is the way to go. Perhaps criminal prosecution is necessary in some cases, but I do get concerned about overly zealous prosecution with some of these types of laws.
