I'm aware of that clause, Senator. Actually I had to dismiss a few cabinet officials during my term. Problem is, Duke did not fire Ben. He sought potential replacements but didn't go further. And he did say Ben "offered his resignation" but that doesn't necessarily mean "has resigned" and I am unsure if the President can simply announce someone else's resignation and it becomes so. Tyrions resolution should take care of that even if I would make it more specific.

So the problem is a complete lack of clarity. Ben has been going as Attorney General Ben this whole time so I don't know why his resignation should be presumed but thankfully things are all taken care of now. In my opinion, though, if impeachment is not gking to be used for cases such as this perhaps we should abolish impeachment altogether.

Yeah. This is a cut and dried situation for impeachment.

If Ben has resigned, then why the Nay votes? You can't impeach an officer who doesn't hold the position.

Right, I can't impeach someone who doesn't hold a position, thus I vote Nay on impeaching such a person.

So on the off chance that Ben still holds the position, you'd just let him keep it while you posture about ambiguity in the law?

This is still at 5-3. It looks like the President has appointed Maxwell to the position. As I don't seen an official resignation from Ben, until Maxwell (or someone else) swears in, Ben should technically still be in office. I will leave the vote open until a majority is reached or a new AG is sworn in.
