Honestly this might be one of the most unnecessary ideas for laws I've seen in recent memory.... Why this even requires legislation is beyond me... isn't it common sense to just not stick a camera up a lady's skirt?

Uhhhh... any instance of this would easily fall under sexual harassment, so what the hell is the point of this? 

EDIT: Originally I read this as girls would no longer be able to take their own upskirt photos of themselves, and a lengthy tirade was about to ensue.  Luckily I was a bit more thorough.

If it is illegal to take a picture up a girls skirt, it might as well be illegal to publish it, though frankly I don't see how this could be enforced (how do we know the picture was not some type of voluntary fetish thing, for example).

The Supreme Judicial Court's ruling included an explicit request for the General Court to hurry up and make this illegal, so I don't think we should blame them for it.

Not at all.  The judges gave the correct legal ruling here.  You can tell from the language of the opinion that they weren't happy with the opinion they had to give, but they properly applied the law, and judges should not be faulted with the Legislature's poor crafting of the statute.
