To take a photo up someone's skirt? I feel like that might be a bridge too far, honestly. I mean I guess it would be different if the person in question is completely aware of the fact that they're 'broadcasting' but it seems a little f**king creepy to be taking pictures of people without their consent. We wouldn't want the state doing this, would we? I guess I need more of a context of what the law in question specifically bans, but I don't find it entirely objectionable to ban non-consensual photography of peoples' private parts (clothed or unclothed), for obvious reasons.

Because the State Supreme Court ruled that the current law (which of course was written decades ago) did not specifically prohibit it. So while you'd think the first part of your post per the court that's not true.

Upskirting is taking a camera, and then going under a woman who's wearing a Skirt legs, then taking a picture below.

That is just nasty.

Aye (D). Saying that this does not violate privacy because it's done in a public place is missing the point. A woman does not expect her undergarments to be seen in ordinary circumstances, so placing a camera in a particular spot does violate her privacy.

How so? Do you mean that someone takes a picture without ill intent, and it happens to show underwear/buttcrack/cleavage/etc., and that person sues?
