At the very least, I won't have to post bail for Duke anymore.

As a heavy drinker, I support this bill.

I'm usually not a fan of this type of legislation, but the bill does not allow for any type of disorderly conduct, which makes it quite reasonable. My concerns here are related to the consumption of decriminalized drugs, since I'm not sure it would be a good idea to allow for their consumption in public spaces.

So this bill would end the possibility of smoking ban in public places?

I am completely against this. Localities and communities have every right to regulate things like public smoking and things that affect their community in such fashion as long as people are free to depart from the community to one that allows public smoking.

I cannot understand the desire of Senator TNF to deprive communities of the right to protect its citizens from the voluntary, irresponsible actions of a few.

Federal law currently prohibits the public consumption of some substances. I am very much in favor of getting rid of that prohibition, but I think localities are best able to decide when and where to make restrictions.

The purpose of this bill is to end the harassment of otherwise law abiding citizens by law enforcement. It does not allow for anything more than that, and would not allow folks to not get in trouble for other criminal activities they may engage in while under the influence. It simply ends the charging of persons with a crime simply for being intoxicated in public.

I stand with TNF here, hand in hand. We mustn't punish people for enjoying booze as much as I do.

Maybe if a drunk is harassing someone, sure, but otherwise, taking them in because they seem drunk should never happen. As a drunk myself, this will be a welcome day when we end this practice.

I really don't care about the booze man. Tongue

Marijuana is typically smoked and clause 3 of Section 2 could prohibit smoking bans from being applied to them by local communites. That is unacceptable to me. It is one thing to repeal smoking bans at the federal level, but it is quite another to then to use the power of the Federal Government to forcefully pollute the air breathed by the vast majority just so that an irresponsible minority is not inconvenienced. It should be left up to the individual communities to make that decision.

Its an improvement to be sure, but I need to consider it some.

I don't like the limitations placed in number 4.

Aye

This is a worthwhile bill, but I certainly wouldn't mind duke vetoing it so more work can be done on it.
