Not surprising.  It's pretty clear that the court would've had to have challenged the validity of Roe v. Wade and Planned Parenthood v. Casey had it wanted to uphold the law.

Agreed.  While I think both cases were badly decided, lower courts don't get the privilege of overturning the Supreme Court.  I don't see this court as wanting to revisit the issue now so assuming North Dakota appeals all the way up, I expect SCOTUS to deny cert.

Wow in 6 weeks you can hear the heartbeat? Yeah courts were wrong for this.

In the hypothetical, it's not the job of the judge to determine what's life and what's not, but to appraise a case on its constitutionality. If somehow there's a loophole in a law allowing mass murder, than that's what the law says and it's a commentary rather on how we should legislatively (or in this case through an amendment) change what's already written.

Uhhh... A federal court used a decision by another federal court as precedent.  This is... Far from uncommon.

This was never going to fly, and it has nothing to do with viability. I'm not sure why North Dakota bothered.

Horrible decision. This should be a states decision and erroring in favor of the pro-life law. (Only acceptable and Constituitional ruling)

Regardless of my personal views on abortion, Roe v. Wade was based on rather unsound constitutional arguments.
