The individual in question, twenty-four year old Cody Wygant was charged with third degree murder and willful child neglect in the death of his son Daymean. Cody Wygant has an extensive criminal history in California, where he moved from in California with crimes ranging from trespassing to rape.

Wygand is being held without bail in the Citrus County Jail, and faces a minimum of fifteen years in prison (on the third degree murder statute).

There is no word on what game he was playing and TV Show he was watching (the police report says he watched three episodes of a show)
