I am not a fan of "let the people decide it" doctrine, since I think we are sent her to exercise our discretion to act in there best interest both short and long term. However, I am having a hard time determining that here and my natural instinct would be to side with fewer prosecutions even at the risk of some people walking. However, I think this one is better crafted and could very well resolve a thorny problem. If Duke's opinion is represenative of the people though, then this will likely be defeated in the Regions.
