Looking at the video that the article linked by snowstalker claims to show the NYPD slamming a protestor into a window, I don't see that.  To me it looks like the protestor in his efforts to escape the grasp of the cops arresting him managed to ram his own head into the window.  Of course, perception is somewhat subjective, which is why we have juries that we hope will be both unbiased and provide a variety of viewpoints.

For instance, what the NYT reports of the evidence shown at the trial is considerably at variance with the description of McMillian as nonviolent.
