In a 7-2 decision, the Supreme Court has ruled that the EPA is permitted to regulate most of the greenhouse gas emission sources that it planned to. Four left-leaning justices (Breyer, Ginsburg, Kagan, and Sotomayor) ruled in favor of the EPA, along with swing justice Kennedy, Chief Justice Roberts, and conservative justice Scalia. Right-leaning justices Thomas and Alito dissented.
On the other hand, a five justice majority (Roberts, Kennedy, Scalia, Thomas, and Alito) rejected the EPA's argument that they were permitted to use the Clean Air Act to justify the regulation of sources of greenhouse gases.
