(1) we wouldn't have the mess that we are now in, and
(2) partisan composition of Congress would not matter so much.

I'd take that with a grain of salt. Nixon also asked Robert Byrd to sit on the SCOTUS, but I think it was more of an attempt to flatter two Senators than a serious proposal.

You're certainly correct about Byrd. He was placed on the list, but the White House officials made it clear he's not a "serious contender". I didn't think it was a case for Baker, since he was yet to ascend into the power in the Senate. From the tapes (at least it's my impression) it's seems Nixon was receptive to have him on the Court, but it just took way too long for Baker to make up his mind.
