The only one I could really vote against is Thomas. Even putting aside Anita Hill and Thomas's far-right judicial philosophy, I don't think that a year on the DC Circuit and 8 years as head of the EEOC really qualifies someone to be a Supreme Court Justice.

I also would've voted against Harriet Miers and Sandra Day O'Connor due to their relative lack of qualifications, although with hindsight I would've voted for O'Connor.

Yea to all but Harriet Miers.

SCOTUS justices are the prerogative of the president to choose. As long as they are qualified (have written extensively on constitutional issues and demonstrated a consistent interest in them), they should be confirmed regardless of their specific judicial philosophy.

Harriet Miers is the only one who indisputably failed that test.

Based solely on what was known at the time of their confirmation votes (the latter numbers were their actual confirmation votes in the Senate):

Chief Justice Roberts - Aye (78-22)
Justice Alito - Nay (58-42)
Justice Breyer - Aye (87-9)
Justice Ginsburg - Aye (96-3)
Justice Kagan - Aye (63-37)
Justice Kennedy - Aye (97-0)
Justice Scalia - Aye (98-0)
Justice Sotomayor - Aye (68-31)
Justice Thomas - Nay (52-48)

Harriet Miers (bonus) - Aye (N/A)
Robert Bork (bonus) - Nay (42-58)

I only would have voted for Miers because I knew we'd be getting a right-wing ideologue if she didn't get confirmed (I knew it would happen at the time and I was right).
