There are now only 19 states left where bans have either not yet been struck down or which have already implemented marriage equality into law. Among them, only three are Democratic leaning or toss up states; Nevada, Ohio and North Carolina. Then comes Arizona and Georgia...

Crazy how fast the dominoes have been falling in 2014. Back when the first state supreme court rulings or legislative actions in the 2000s it was always a big celebratory event. Now with so many gay marriage bans being struck down I just shrug my shoulders.

Yeah, anyone who has been through law school is quite familiar with Posner's writing style. His opinions usually make for an entertaining read.

Well after the verbal smackdown the court gave to the attorneys from IN and WI, it is no surprise, but the ruling is full of win.

well, not so fast. The one Federal judge (from LA) who has ruled in favor of SSM ban was Reagan appointee.

I suppose I ended up predicting the margin, but that really was a very fast ruling and a complete obliteration of the anti-gay marriage side. I did not expect the ruling to come down that fast.

I want to note that the Ninth Circuit will be hearing its case on September 8. The judges there will be Reinhardt (Carter-appointee and author of the Prop 8 case), Berzon (Clinton-appointee), and Gould (Clinton-appointee). This one is a slam dunk for supporters of marriage equality. Like the Seventh Circuit, I think this will be another 3-0 unanimous ruling. And with current Ninth Circuit precedent, sexual orientation should be elevated to protection under heightened scrutiny (above rational basis).

Question....will the ninth circuit decision affect just Idaho and Nevada, or all of the ninth circuit states?

State legislatures cannot nullify the Constitution of the United States or rulings of the Supreme Court except collectively and with two-thirds of both Houses of Congress in the amendment of the Constitution.
