There is currently one state with a stayed non-federal ruling (Arkansas)
Four states with stayed district rulings (Texas, Michigan, Kentucky, Florida)
And this 9th circuit ruling, which I'm not sure whether is stayed.

Anyways, that's 32 states that have gay marriage, or have a stayed ruling. That's not counting states that weren't explicitly ruled for in a circuit that has ruled for gay marriage. For example, Alaska, Arizona and Montana are also in the 9th.

The 4th, 7th, 9th, and 10th have all ruled for gay marriage, but only in the 7th has it applied to the full circuit.

The district rulings are in the 5th, 6th, and 11th.
Gay marriage is already completely legal in the 1st, 2nd, 3rd, and DC.
That leaves the 8th with no federal ruling.

I'll give you that, but it should happen soon, maybe after election day if some of them are Lame-Ducks.

Excellent news. Looks the ruling won't be stayed (it would have been silly to stay it pending appeal after the Supreme Court's (in)action yesterday).

And we can add Alaska, Montana, and Arizona to that same awkward "maybe/ soon" category.

Specifically in the case of South Carolina, the case that was being heard was suspended until the Fourth Circuit's ruling was final.  The judge in that case has ordered the two sides to present briefs to her no later than 15 October.  So the earliest there would likely be weddings here would be next Thursday.

Everybody take a deep breath.

The temporary stay that Kennedy issued here was procedural and pretty much automatic. That fact that it's Kennedy in particular is insignificant. Kennedy is in charge of handling emergency motions from the 9th Circuit. Recall that the Supreme Court stepped in to stay the previous circuit court rulings pending appeal (and IIRC it was Sotomayor who stayed the 10th Circuit case) . However, this one may only be temporary. Kennedy has  ordered the plaintiffs to prepare a response brief by the end of tomorrow. The Supreme Court may very well decide that, unlike last time, a stay pending appeal to the Supreme Court is unwarranted given that the Court is extremely unlikely to grant cert in the Idaho case on basically identical facts to the petitions it just rejected this week.
