Option 2-I don't really see the point in keeping someone like Jared Lee Loughner or Anders Bering Breivik alive but I'd rather get rid of the death penalty than have the disaster of a system we have rn

Option 2. I don't consider it inherently immoral to execute murderers (people forfeit their rights to the extent that they violate the rights of others), but if you're going to give the State a legitimate avenue by which to kill those who live under it, you need to have a pretty solid appeals process or similar mechanism to ensure beyond any doubt that people being executed are actually guilty. Since such mechanisms will almost always cost more than simply jailing a murderer (FTR, I prefer ostracism to imprisonment, but that isn't going to happen anytime soon), I see no way for the death penalty to be neither unjust nor wasteful.

Option 1, though I don't care about the issue so long as we fix innocent people being killed, but I don't think there's any way to get rid of that.

I believe that the main function of the justice system should be to provide restitution for the victim (or the victim's next-of-kin, in the event of murder). I am not necessarily opposed to the institution of punishment, but it should only serve a role as a deterrent and be secondary to restitution. Thus, the function of the court system should be to determine whether the next-of-kin would be justified in exacting their "restitution" (whether it be vengeance killing, indentured servitude, or something else) from the defendent. The problem with the current justice system is that it makes offenses crimes against the state, rather than against individuals, and thus prioritizes punishment rather than restitution. Additionally, those wrongfully executed or indentured should be able to seek restitution as well, which would greatly reduce the chance of wrongful punishment, unlike the current system where the worst case scenario for the state is bad publicity.

Option 2, there are people out there who's actions probably warrant the death penalty.

However the system is a disaster and I don't think it can be improved.

Somewhere in between options 1 or 2, voted 1.  While I believe some people deserve to die, it's not possible for society to accurately determine who does all the time.  I firmly believe that society should not have the power to kill its members.  As long as society has this authority, someone will be executed who shouldn't be.

There are some cases where I do not feel a murder should be executed, and there are some where I feel they should. However I recognize that much of this is subjective.  Better to say that the state does not have such an ultimate authority of deciding who deserves to live or die, so long as there are other options for public safety.
