Apparently the standard set in Texas law is Lennie Small from Of Mice and Men. Like actually. Unbelievable that this is allowed to happen.

Because the use of a single numerical measure, especially one not designed to measure the specific area of moral intelligence, as a sufficient determinant of whether the killer was morally culpable makes no sense. Intelligence is too complicated to be boiled down to a single number.

Wouldn't everyone either be smart enough to intentionally fail the IQ test, or fail on their own merit?

As someone who is against the death penalty, I don't really see why mental disability would make it wrong if it is not wrong otherwise. If this person was judged to be culpable for murder in spite of any mental disability, then what is the crucial factor?

If the death penalty is going to be used, than the best way to do it is to reject challenges based on mental status/age and instead require appeals to based on the merits and legal foundation of the law at question and the legality/merits of the trial. Obviously, this means all fifty states should pay for lawyers for the appeals process (should the defendant not be able to afford one), just as they would at trial.
