On Sunday evening before a stay would be lifted on Monday of a federal court ruling saying Alabama's ban on same sex marriages is unconstitutional, Alabama Supreme Court Chief Justice Roy Moore issued an administrative order instructing Alabama's probate judges not to issue or recognize a marriage license for same sex couples.

The order reads in part:

Well if someone was going to play the Governor Wallace role in SSM, it was going to be Roy Moore.

It will be interesting to see how other Republicans react, especially the 2016ers. Who will support him? Obviously Huckabee, and probably Santorum. But what about Rand Paul and Scott Walker? And how will the likes of Jeb Bush avoid having to answer the question

Judge Roy Bean -- excuse me, Judge Roy Moore -- has a poor record in courts upholding his decisions. I predict that he will get a judicial smacking very fast, most likely a ruling of "no standing".

Ahh, Roy Moore. I knew he'd turn up here somewhere. So he ordered probate judges to ignore a federal court ruling that that SCOTUS wouldn't even put on hold. Nice. I wonder if he'll order them to ignore the SCOTUS once its ruling comes down?

Here's a map showing the current situation by county in AL regarding marriage licenses. Dark blue means that the county is issuing opposite-sex licenses but refusing to issue same-sex licenses; blue shows counties that have abandoned issuing licenses to anyone; red shows counties that are taking applications but not issuing licenses at the moment and dark red shows counties that are issuing same-sex licenses as of now.

Is there any action any form of government can take to force all counties to follow the ruling? Can't they be arrested or removed from their jobs for not following the ruling?

Couples just have to start suing all the individual probate judges in their counties in federal court to get injunctions ordering them to comply with the original ruling.

Not sure what state government remedies might be available, but it doesn't sound like anyone in the Alabama government is particularly inclined to take action.

Yeah, you'd sue for noncompliance. Perhaps telling, a majority of justices declined the stay on the federal court ruling with only the goodly Clarence Thomas and Antonin Scalia issuing a dissent (in favor of a stay). I can't imagine Alito voting for SSM, so maybe it's around 6-3 for it.

"Blah blah state issue" is probably what we'll hear from them.

Not to mention the SCOTUS will almost surely have taken the issue away by striking down SSM bans before Nov 2016. At which point the Jeb Bush and Scott Walker types will make their expected statement against 'judicial activism', then quickly let the matter drop with an inner sigh of relief.

What are those percentages of?  The counties?  It seems like a bit of a misleading statistic.  It's pretty evident that Obama voters are, by and large, not the architects of an orchestrated plot to dismantle marriage equality in this state.

Interesting to note the absence of Macon county from either list.  I would be surprised if it were not recognizing same-sex marriages.

On what legal grounds specifically do you disagree with the federal district judge's decision?
On the grounds that the state need only subsidize man woman relationships, as they are most beneficial to the state’s interest in procreation. The courts are destroying the instution of marriage with this horrible activism.
