Rick Santorum pretty much banned that already when he was galavanting around the Senate.

Public Law 109–242

‘‘(c) SOLICITATION OR ACCEPTANCE OF TISSUE FROM FETUSES GESTATED FOR RESEARCH PURPOSES.—It shall be unlawful for any person or entity involved or engaged in interstate commerce to—
‘‘(2) knowingly acquire, receive, or accept tissue or cells obtained from a human embryo or fetus that was gestated in the uterus of a nonhuman animal.’’

But yeah, might as well go for a super-ban, just in case. Because, you know ... Godlessness, and pro-life, and the gays, and what-not.

this violates the 14th amendment equal protection clause

The 14th doesn't protect beings that are fictional (which is a shame because I think Mermaids and Centaurs are cool).
