Given how many people the Nazis killed (It wasn't just Jews if you may recall), I don't believe the swastika should be rehabilitated...unless you're in India. Since India is it's original home, I see few problems with it there...but nowhere else.

The guy is an idiot and the joke was not funny, but making it into a crime is even less funny. At the very most, it should be between him and his fraternity brothers.

Pretty much this. The symbol might have been seen as one of a positive nature before WW2, but after Nazi Germany stole it no one can claim that it means this anymore. This student not only embarrassed himself as an individual, but also as a Jewish person. Tikkun Olam is great, repairing the world and fixing it's problems through social justice is a great idea, but...you shouldn't throw your heritage and your roots under the bus to accomplish that.

It is not just in India it is used (http://en.wikipedia.org/wiki/Swastika). I think more should be done to separate the Nazi Swastika (tilted 45 degrees) from the rest, though I guess it would be a bit of a mission impossible.
