But wouldn't the Registration of Political Parties Act 1998 prohibit "The Liberals" as well?

Indeed, I can't see it being accepted, unless the 1989 Liberal Party either agrees to it (unlikely) or folds.  I get the impression that they're gradually fading; they only had four candidates this year, and only Steve Radford held his deposit (and that was closer than it's been in the past), but they still have a handful of councillors scattered around.

The Liberal Democrats are a merger between the SDP and the Liberal Party. Both the SDP and the Liberal Party still exist 'in continuity.'

That is correct -- the old Liberal Party voted to merge with the SDP, and the 1989 Liberal Party was formed by members who rejected the merger -- but the current legislation on registration of parties did not exist in 1988/89, and as the splinter group is registered under the name "The Liberal Party" I don't see how the Lib Dems can formally adopt that name (or "The Liberals", which would be too similar).

If they drop the Liberal name then they might as well fold. Most of the votes they actually held onto were for that name.

When the Liberal Party and the SDP merged they were officially the Social and Liberal Democrats (the acronym for Liberal and Social Democrats being considered unwise). They originally tried using the Democrats as a short name. It was tried out in a by-election but the electorate did not understand who they were. The short name Liberal Democrats was then adopted and eventually became the official name of the party.

For better or for ill liberal has been a word used to describe the party and its predecessors for almost two hundred years. To abandon the word probably would kill the party.

Farron is in, with Mulholland as campaign manager.  There's talk of "rebranding", but not of actually changing the name (probably because, as discussed above, the obvious change isn't possible):

Lembit Opik said today on the Daily Politics that the new leader will need to have a two general election strategy.

Get back into the teens of MP's next time and then up into the 20 and 30's the election after. That's probably their only realistic way forward after the wreckage of last Thursday.

As evidenced by the current fate of the FDP in Germany, centre capital-L Liberal parties tend to survive, even without renaming. A new logo, ad-like posters, a pair of legs, and you're back on track !

Sad news today about the death of Charles Kennedy at the age of 55.

The Liberal Democrats would almost certainly be in a much better condition today had his advice about the coalition agreement in 2010 been followed.
