Capital Punishment Restoration Act

1. Capital punishment is hereby restored under federal law of Atlasia
2. Capital punishment shall be a sentencing option in cases of treason and terrorism
3. Death sentence shall be executed within one week after the Supreme Court affirms a conviction and  President makes a decision not to interfere
4. Death sentence shall be carried out by means of decapitation by the guillotine in a closed, designated prison

Whatever are your views about the death penalty, the federal constitution forbids death penalty, so this bill would be unconstitutional.

This can be amended into a constitutional amendment you know. Perhaps that was lost amongst the screams of unsconstitutional.

Though I do get the sense that long time death penalty opponent, Kal The Crazy Pole introduced this for the lulz, that doesn't mean the Senate is necessarily obligated to leave such intent in place. Ie, we can amend crazy into a serious proposal.

When the abolition of the dealth penalty was passed it was passed by one vote and had Clarenced not resigned when he did (reduced the size of the Senate), it would have failed. Even before that it was illegal in all cases Federally and in every region except the South at the time. So even if the constitutional ban were removed, it wouldn't change much and the South would probably ban it now at the regional. I would prefer it to be their choice frankly hence my vote against tabling.

Well, I guess I should say a few words.

First, my apologies for forgetting about the constitutional issue. From technical point of view, you guys are absolutely right.

Second, in a light of terrorism and rebelion surge, I thought we can actually debate this thing (I'm not necessarily supporting), so I regret there would be no discussion whatsoever, just "omg, table this".

I am surprised this was not an ironic push of sorts on your part. Tongue

Anyway, I do agree. It was just far to easy to trash this bill. It is little wonder why the approval ratings for this chamber plummetted for March (though the poll was conudcted mid April).
