I doubt most people here would let it happen with a warrant. For me, I wouldn't put myself in a situation where my car would have to be searched, period.

Where did I mention a bribe? That's a complete lie. My point was, I wouldn't be running around with anything illegal in my car that would get me in trouble.

Ok. I have nothing in mine either.  You get stopped on the way home.  The cop isn't as trusting as we are and suspects something.  You're not the cleanest guy on earth and your back seat has a lot of sh**t in it. Uh, "Mr. Invisible, do you mind if I have a look in your car just to be sure there's nothing I need to worry about there?".  Your answer is???

If I'm not in a hurry and the cop is respectful I have no problem with it.

le sigh

Of course not.  It doesn't matter if you have illegal things or not, you should never allow a random traffic cop to search your car during a typical traffic stop.  I mean, he may anyway, but not with your consent.  This is Very ImportantTM and it's kind of sad to see people that don't know this.  This is much more important information to have than not knowing that the passing lane is for passing only (my biggest pet peeve when driving).

In Austria, cops can search cars whenever they want.

Which means you have no choice anyway.

Especially because the mandatory warning triangle and first-aid kit is usually in the trunk and police can check for this without notice and you have to open your trunk if asked.

Police here are also required to check cars and drivers at random to look for drunks and drug users, so if you are picked randomly for a stop-and-search operation you will have to comply.

I have nothing to hide, but I'd still refuse on principle.

Actually I'd be likely to allow it only if I were in a hurry. The only circumstances I can think of where I'd be stopped and asked to allow a search would be ones in which the cop would be willing to waste both our times waiting for a warrant.

Yeah, it's easy to say "no" in theory, but when you're actually in that situation and you know the cop isn't going to find anything it can be awfully easy to say go ahead just to "grease the wheels" a little bit. Ironically, the best reason for a strict "no" policy is if you think there will eventually be a time when you really have something to hide. That way, you won't be "acting guilty" when the day comes.

I would say that I do not consent to it, even if s/he tells me there is probable cause. Can't stop them of course, but I'd make it clear I don't consent to it. At least that's what I hope I would do. Realistically I imagine there's a good chance that in the moment I would chicken out and say OK.

Well I'm probably not one to be searched for no reason.  My Doberman rides with me literally everywhere so I'm not at a high risk for some testosterone spewing young cop to search my Jeep without a reason.  I think he'd be fine being on his side of the glass and giving me my ticket.

I would only refuse a search if I had nothing to hide.  Otherwise, I'm not going to increase suspicions by refusing a search.
