There are greyer enhanced interrogation techniques than waterboarding that more easily skirt around the Geneva Conventions. I'd go with those instead. But this is one where I'm not going to be dogmatic. Even Bill Clinton seemed to theoretically leave the door open to this kind of stuff in exceptional "Jack Bauer" circumstances.
