At least three counties have stopped issuing licenses to all couples as a result of the order. This adds to the 11 AL counties who never complied with SCOTUS on the issue (and still don't).

The article said Moore and the Alabama SC is still thinking about how the SCOTUS SSM case affects Alabama law banning SSM. The wheels of justice move slowly down there. Perhaps it's due to the recent inclement weather. Or maybe Moore forgot who won the Civil War or something.

Funny how these far-right wingnuts claim to be "defending the Constitution" from "anti-American socialist progressives", yet ignore the Constitution when it conflicts with their personal beliefs.  And obviously, they are so adamant about "states' rights" that they believe states should have the "right" to violate the Constitution. 

Yes, I disagreed with the SC's decision on gay marriage, but it's the law of the land, and trying to undo it is pointless.  Gay marriage is irreversible because now its supporters can legitimately claim that doing so would take away the constitutional rights of homosexuals.  And in all honesty, anyone who knows and understands the history of constitutional law in the US should have seen it coming 10 or 20 years ago.  It's time that my fellow supporters of traditional marriage concede defeat and move on.

Absolutely. Moore should stand in a courthouse doorway to prevent gays from getting married. Donald Trump, Ted Cruz, Marco Rubio, and Ben Carson should all fly down to Alabama to support him. Defense of Traditional Marriage MUST be the centerpiece of the 2016 Republican campaign. Better yet, the Republican nominee should promise to appoint Roy Moore to the U.S. Supreme Court if elected. That'll lock down their conservative Christian support for sure!

It would be pretty hard to get every county to stop issuing licenses, but if it did happen, it would be a huge mess. You could try to get the district court judge for the state to issue a fresh ruling, but that wouldn't be a guaranteed solution because Moore says only the AL Supreme Court can require SSM, which is run by him and therefore will never issue a favorable ruling on the issue or (likely) even hear such a case. You could look at trying to jail probate judges, but that might not even be possible because AL marriage laws use the word 'may' instead of 'shall' when giving probate judges the power to issue marriage licenses. The 9th circuit and the US supreme court could issue new rulings just for AL in an attempt to make Moore rescind his order, but there's no guarantee Moore would even listen to either of them, since they would likely be tied to grievances of a certain set of specific couples, allowing Moore to use effectively the same argument he's making now to keep his order in effect.

Of course, the nuclear option is for Obama to send in the national guard to force compliance. I'm not sure if Obama is bold enough to do that though.

Roy Moore thinks that Obergefell only applied to the sixth circuit states that were being sued in the case-Michigan, Ohio, and Kentucky. If he'd read two pages into the ruling, Moore would have found this:

The Fourteenth Amendment requires States to recognize same-sex marriages validly performed out of State. Since same-sex couples may now exercise the fundamental right to marry in all States, there is no lawful basis for a State to refuse to recognize a lawful same-sex marriage performed in another State on the ground of its same-sex character.

Roy Moore is a perfect example of what's so dangerous about Antonin Scalia and Clarence Thomas: none of them consider the Constitution in their rulings and simply write decisions based on their own ideology. Hopefully he'll be removed from the bench yet again, just like he was after the Ten Commandments debacle, and same-sex couples in Alabama will be able to sleep at night without having to worry about a senile, evil old man screwing with the legal status of their marriages.
