Actually I have moved to support SSM, because of family and friend issues, but I remain 100% in support of people like Roy Moore and Kim Davis and while I support SSM, I believe it should be left up to the states.

Actually I have moved to support SSM, because of family and friend issues, but I remain 100% in support of people like Roy Moore and Kim Davis and while I support SSM, I believe it should be left up to the states.
I prefer marriage being abolished as a legal institution and replaced with civil unions (with people being free to call their arrangement whatever they want), though until that day comes, the constitution matters. And the Constitution calls for equal protection.

Furthermore, while I am a firm supporter in state's rights, I don't see how you can support people's rights being denied in other states. Alabaman's might vastly disapprove of same-sex marriage, but they have no right to deny their fellow Alabamans their right to marry due to their objections. That is basically collectivism (tyranny of the majority), not conservatism. Kim Davis is no different from a socialist in the way she uses government power, and Roy Moore is not far behind her.

I see directly where you are coming from, my favorite solution would be to get the Feds and states out of the marriage business all together and make it between you, your spouse to be, the priest or Justice of the Peace, but I acknowledge that, in our current political climate where people care more about where Ted Cruzs mom was born to government intervention into part of society where it shouldn't.

This old canard again...

This canard is gay and believes every gay citizen should have the same rights as everyone else. Leaving it up to the states is pretty much an excuse to never have gay marrige... what if segregation was left up to the states? The supreme court is there for a reason. Roy Moore is a disgrace and will be left in the history books as a loser.

Of course every gay citizen should have the same rights as everyone else; not because that won't hurt others (heck, most cases of murder don't hurt me) but because it's the right thing to do. Also, you don't have to be "obsessed" with gay sex to be against SSM. You just have to disrespect gay people's rights, which is problematic enough in and of itself. Let's not blow things out of proportion.

And yeah, this Moore guy is an asshat.

Actually he loves America. While I believe it should be up to the states, I and the judge oppose it. Even those of the left have to recognize that if you take a strict constructionist view of the Constitution, the SCOTUS has to honor the state's rights position because the issue of marriage is not in Article 1 Section 8 of the Constitution therefore the status quo (prior to the recent overturnings of the bans) must be what is returned to. Meaning Prop 8 is restored as part of California's Constitution. Also Indiana has its ban on the practice restored and we could've had our vote to put it into our Constitution.

Basically it boils down to one of two things: the Tenth Amendment invalidates the entire constitution and there is no government at all, or it means that the constitution is no longer in force and our government is based on the Republican Party platform.

Are you seriously asserting that the Bill of Rights is not self enforcing and requires Congressional legislation to be enforced?  I tend to favor a greater standard of deference to legislative bodies than most people, but with the exception of overturning DOMA, none of the SSM cases had anything to do with Congressional power concerning SSM, and in Windsor, your argument would be yet another reason to have overturned DOMA and require the Federal government to recognize State recognized SSMs.

Roy Moore thinks that Obergefell only applied to the sixth circuit states that were being sued in the case-Michigan, Ohio, and Kentucky. If he'd read two pages into the ruling, Moore would have found this:

The Fourteenth Amendment requires States to recognize same-sex marriages validly performed out of State. Since same-sex couples may now exercise the fundamental right to marry in all States, there is no lawful basis for a State to refuse to recognize a lawful same-sex marriage performed in another State on the ground of its same-sex character.

Roy Moore is a perfect example of what's so dangerous about Antonin Scalia and Clarence Thomas: none of them consider the Constitution in their rulings and simply write decisions based on their own ideology. Hopefully he'll be removed from the bench yet again, just like he was after the Ten Commandments debacle, and same-sex couples in Alabama will be able to sleep at night without having to worry about a senile, evil old man screwing with the legal status of their marriages.
